Please read these terms carefully before using 21Jobs. By accessing or using our platform, you agree to be bound by these terms.

1. Introduction & Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Code-11 GmbH, a limited liability company incorporated under the laws of Switzerland, with its registered address at c/o Bättig Treuhand AG, Winkelriedstrasse 7, 6003 Luzern, Switzerland ("Company", "we", "us", or "our"), the operator of the 21Jobs platform.

By accessing, browsing, or using the 21Jobs website at 21jobs.io and any associated services, applications, or content (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

If you do not agree to these Terms in their entirety, you must not access or use the Service. Your continued use of the Service following any modifications to these Terms constitutes your acceptance of such modifications.

2. Definitions

  • "Service" means the 21Jobs website, platform, APIs, and all related services operated by Code-11 GmbH.
  • "User" means any individual or entity that accesses or uses the Service, including job seekers, employers, company representatives, and visitors.
  • "Content" means all text, data, information, images, graphics, logos, and other materials displayed on or available through the Service.
  • "User Content" means any content, information, or materials that a User submits, posts, or transmits through the Service.
  • "Job Listing" means any job advertisement, posting, or vacancy information displayed on the Service.
  • "Account" means a registered user account on the Service.
  • "Subscription" means any paid plan or service purchased through the Service.
  • "Promotion" means any paid advertising or featured placement purchased by employers or companies on the Service.

3. Eligibility

You must be at least 18 years of age to access or use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. If you are using the Service on behalf of a company, organization, or other entity, you represent and warrant that you have the authority to bind that entity to these Terms.

We reserve the right to request proof of age or identity at any time and to suspend or terminate access for any User who does not meet the eligibility requirements.

4. Account Responsibilities

When you create an Account, you must provide accurate, complete, and current information. You are solely responsible for:

  • Maintaining the confidentiality and security of your account credentials, including your password
  • All activities that occur under your Account, whether or not authorized by you
  • Notifying us immediately at legal@21jobs.io of any unauthorized use of your Account or any other security breach
  • Ensuring that your Account information remains accurate, complete, and up to date at all times

You may not use another person's Account without their express permission, nor may you create multiple Accounts for deceptive, fraudulent, or abusive purposes. We reserve the right to suspend or terminate any Account that contains inaccurate information, is used for fraudulent purposes, or violates these Terms, without prior notice and without liability to you.

5. Service Description

21Jobs is a job board and job listing aggregation platform focused on the Bitcoin, cryptocurrency, and Web3 industry. We aggregate job listings from various external sources, including third-party applicant tracking systems (such as Lever, Ashby, Greenhouse, and Recruitee), company websites, and other publicly available sources.

  • 21Jobs is not an employer, recruitment agency, staffing firm, employment advisor, or intermediary.
  • We do not verify the identity, credentials, legitimacy, or financial standing of any employer, company, or job seeker on the platform.
  • We do not guarantee the accuracy, completeness, timeliness, or reliability of any Job Listing or company information.
  • We do not endorse, recommend, or guarantee any employer, company, job opportunity, or employment outcome.
  • We do not participate in or mediate any hiring process, employment relationship, or contractual arrangement between Users.

Any interaction, communication, or transaction between job seekers and employers occurs entirely at the Users' own risk and responsibility. We strongly recommend that all Users conduct their own independent due diligence before entering into any employment relationship, contract, or financial arrangement with any party found through the Service.

6. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in strict accordance with these Terms. You agree not to:

  • Post false, misleading, fraudulent, or deceptive job listings, company information, or other content
  • Scrape, crawl, spider, harvest, data mine, or use any automated means (including bots, scripts, or similar technologies) to access, extract, copy, index, or collect data from the Service without our prior written consent
  • Access, probe, or test the vulnerability of the Service or any related system or network, or breach any security or authentication measures
  • Interfere with, disrupt, or impose an unreasonable or disproportionate load on the Service, its servers, or networks
  • Use the Service to distribute spam, unsolicited communications, malware, viruses, or any other harmful or malicious content
  • Impersonate any person or entity, or falsely state or misrepresent your identity, affiliation, or authority
  • Harass, abuse, threaten, defame, or discriminate against any other User or individual
  • Use the Service for any purpose that violates any applicable local, national, or international law, regulation, or ordinance
  • Collect, store, or process personal data of other Users without their explicit consent and a valid legal basis
  • Reproduce, duplicate, copy, sell, resell, sublicense, or exploit any portion of the Service for commercial purposes without our express written permission
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service
  • Remove, alter, or obscure any copyright, trademark, or other proprietary rights notices on the Service
  • Use the Service to post job listings that require applicants to pay fees, make upfront investments, or participate in multi-level marketing or pyramid schemes

We reserve the right to investigate any suspected violation of these Terms and to remove any content, suspend or terminate any Account, and take any other action we deem necessary, at our sole discretion and without prior notice or liability to you.

7. User Content & License

You retain ownership of any User Content you submit to the Service. However, by submitting, posting, or otherwise making available any User Content on or through the Service, you grant Code-11 GmbH a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such User Content in connection with the operation and promotion of the Service.

You represent and warrant that:

  • You own or have the necessary rights, licenses, and permissions to submit the User Content
  • The User Content does not infringe, misappropriate, or violate any third party's intellectual property rights, privacy rights, or other legal rights
  • The User Content does not contain any unlawful, defamatory, obscene, or otherwise objectionable material
  • The User Content is accurate and not misleading

We are under no obligation to monitor, review, or edit User Content, but we reserve the right to remove or modify any User Content at any time, for any reason, without notice.

8. Intellectual Property

The Service and all of its original content (excluding User Content), features, functionality, design, graphics, logos, trademarks, trade names, source code, and documentation are and shall remain the exclusive property of Code-11 GmbH and its licensors. The Service is protected by copyright, trademark, trade secret, patent, and other intellectual property laws of Switzerland and international treaties.

The "21Jobs" name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Code-11 GmbH. You may not use such marks without our prior written consent. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

9. Subscriptions & Payments

Certain features of the Service are available through paid Subscriptions or one-time Promotion purchases. By purchasing a Subscription or Promotion, you agree to the following:

  • You agree to pay all fees and applicable taxes as described at the time of purchase
  • Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date
  • You may cancel your Subscription at any time; access to paid features continues until the end of the current billing period
  • Refunds are handled on a case-by-case basis at our sole discretion and are not guaranteed
  • We reserve the right to modify pricing at any time with reasonable advance notice; continued use after a price change constitutes acceptance
  • We may offer free trials or promotional pricing at our discretion; such offers may be subject to additional terms

All payments are processed securely through Stripe, a PCI DSS Level 1 certified payment processor. We do not store your payment card details on our servers. Your use of Stripe is subject to Stripe's own terms of service and privacy policy. You authorize us (and Stripe, as our payment processor) to charge the payment method you provide for all fees incurred.

If a payment fails or is declined, we may suspend or restrict access to paid features until the outstanding balance is resolved. You are responsible for ensuring that your payment information is current and valid.

10. Third-Party Links & Services

The Service may contain links to third-party websites, services, or resources that are not owned or controlled by Code-11 GmbH. This includes, but is not limited to, links to employer websites, job application pages, and external applicant tracking systems.

We have no control over, and assume no responsibility for, the content, accuracy, privacy policies, practices, availability, or security of any third-party websites or services. We do not endorse or assume any liability for any third-party sites, information, materials, products, or services.

Your use of third-party websites and services is at your own risk and is subject to the terms and conditions and privacy policies of those third parties. We strongly encourage you to review the terms and privacy policies of any third-party website or service that you visit or interact with through the Service.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • The Service is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, statutory, or otherwise.
  • We expressly disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, completeness, and availability.
  • We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or free of viruses, malware, or other harmful components.
  • We do not warrant that the results obtained from the use of the Service will be accurate, reliable, or meet your requirements or expectations.
  • We do not warrant that any Job Listing, company information, salary data, or other content on the Service is accurate, complete, current, or reliable.
  • We do not warrant that any defects or errors in the Service will be corrected.
  • No advice or information, whether oral or written, obtained from us or through the Service shall create any warranty not expressly stated in these Terms.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

In no event shall Code-11 GmbH, its directors, officers, employees, agents, affiliates, licensors, or service providers be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for:

  • Loss of profits, revenue, income, business, or anticipated savings
  • Loss of data, goodwill, or reputation
  • Business interruption or loss of business opportunity
  • Cost of procurement of substitute goods or services
  • Any employment decisions made based on information found on the Service
  • Any losses arising from interactions with employers, companies, or other Users
  • Personal injury or property damage related to your use of the Service
  • Unauthorized access to or alteration of your transmissions or data
  • Any other matter relating to the Service

— whether based on warranty, contract, tort (including negligence), strict liability, or any other legal theory, and whether or not we have been advised of the possibility of such damages.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount you have paid to us in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) CHF 100 (one hundred Swiss Francs).

The limitations and exclusions in this section apply regardless of the form or source of the claim or loss, whether the claim or loss was foreseeable, and whether a party has been advised of the possibility of the claim or loss. Some jurisdictions do not allow the exclusion or limitation of certain damages; in such jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

13. Web3 & Cryptocurrency Industry Disclaimer

You acknowledge and agree that the Bitcoin, cryptocurrency, blockchain, and Web3 industry ("Crypto Industry") involves unique and significant risks, including but not limited to:

  • Extreme market volatility and financial uncertainty
  • Rapidly evolving and uncertain regulatory environments across jurisdictions
  • Risk of company insolvency, bankruptcy, or sudden cessation of operations
  • Risk of fraud, scams, rug pulls, and other deceptive practices
  • Risk of hacking, security breaches, and theft of digital assets
  • Lack of traditional consumer protections and insurance mechanisms
  • Companies may operate in jurisdictions with limited legal recourse

21Jobs is a job listing platform only. We do not provide investment advice, financial advice, legal advice, or tax advice. We do not verify the regulatory compliance, financial stability, or legitimacy of any company listed on the platform.

You assume all risks associated with applying for, accepting, or working in positions at companies in the Crypto Industry. Code-11 GmbH shall have no liability whatsoever for any losses, damages, or adverse outcomes arising from your employment or engagement with any company found through the Service, including but not limited to non-payment of wages, loss of cryptocurrency-denominated compensation, company failure, or regulatory enforcement actions.

14. Indemnification

You agree to defend, indemnify, and hold harmless Code-11 GmbH and its officers, directors, employees, agents, affiliates, successors, and assigns from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to reasonable attorney's fees and legal costs) arising from or relating to:

  • Your access to or use of the Service
  • Your violation of any provision of these Terms
  • Your violation of any applicable law, rule, or regulation
  • Your violation of any third party's rights, including intellectual property, privacy, or publicity rights
  • Any User Content you submit, post, or otherwise make available through the Service
  • Any claim that your User Content caused damage to a third party
  • Any employment relationship or dispute arising from your use of the Service
  • Any misrepresentation made by you

This indemnification obligation shall survive the termination of these Terms and your use of the Service.

15. Termination

We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including but not limited to:

  • Breach of any provision of these Terms
  • Fraudulent, abusive, or unlawful activity
  • Non-payment of fees
  • Request by law enforcement or other governmental authority
  • Discontinuation or material modification of the Service
  • Unexpected technical or security issues

You may terminate your Account at any time by contacting us at legal@21jobs.io or by using the account deletion feature in your account settings.

Upon termination: (a) your right to use the Service will cease immediately; (b) any outstanding fees remain due and payable; (c) we may delete your Account and associated data in accordance with our Privacy Policy. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, limitation of liability, indemnification, and dispute resolution provisions.

16. Force Majeure

Code-11 GmbH shall not be liable for any failure or delay in performing its obligations under these Terms to the extent that such failure or delay results from circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, civil unrest, embargoes, sanctions, pandemics, epidemics, public health emergencies, government orders or regulations, labor disputes or strikes, fire, flood, earthquake, power outages, internet or telecommunications failures, cyber attacks, hacking incidents, denial of service attacks, failures of third-party service providers, or any other event that is unforeseeable or, if foreseeable, unavoidable. During any such period, our obligations shall be suspended, and we shall not be liable for any resulting damage or loss.

17. Dispute Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service ("Dispute"), the parties agree to the following resolution process:

Step 1: Amicable Resolution (30 Days)

Before initiating any formal legal proceedings, the aggrieved party shall first attempt to resolve the Dispute amicably by sending a written notice to the other party describing the nature of the Dispute and the relief sought. The parties shall use good-faith efforts to resolve the Dispute through direct negotiation within thirty (30) days from receipt of such notice. Notices should be sent to legal@21jobs.io.

Step 2: Court Proceedings

If the Dispute cannot be resolved amicably within the thirty (30) day period, either party may submit the Dispute to the competent courts of the Canton of Lucerne, Switzerland, which shall have exclusive jurisdiction. Code-11 GmbH reserves the right to bring proceedings in any other court of competent jurisdiction for the purpose of seeking injunctive or other equitable relief.

18. Governing Law

These Terms and any Dispute arising out of or in connection with them or their subject matter (including non-contractual disputes or claims) shall be governed by and construed exclusively in accordance with the substantive laws of Switzerland, without regard to its conflict of law principles or provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is expressly excluded.

19. General Provisions

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices or agreements published on the Service, constitute the entire agreement between you and Code-11 GmbH regarding the Service and supersede all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral.

No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. A waiver of any provision shall be effective only if made in writing and signed by an authorized representative of Code-11 GmbH. No waiver shall constitute a continuing waiver or a waiver of any other provision.

Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without our prior written consent. Code-11 GmbH may freely assign, transfer, or delegate its rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

Headings

The section headings in these Terms are for convenience only and shall not affect the interpretation of any provision.

20. Changes to These Terms

We reserve the right to modify, amend, or replace these Terms at any time at our sole discretion. If a revision is material, we will provide at least thirty (30) days' notice prior to the new terms taking effect, by posting the updated Terms on the Service and updating the "Last updated" date. What constitutes a material change will be determined at our sole discretion. Your continued access to or use of the Service after any revisions become effective constitutes your agreement to be bound by the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
